1. This Is Our Contract
Welcome to visayes (“visayes”, “we”, “us”), an independent software service. These Terms of Service (the “Terms”) govern your use of the visayes website, browser extension, and related services (together, the “Service”).
By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What visayes Is — and Is Not
visayes is a software tool. It helps you understand, prepare, and pre-fill official border-entry forms (such as digital arrival cards), and can assist you in typing that information into official websites.
visayes is not a visa agency, immigration consultancy, or travel agent. We never submit anything on your behalf. You always review your information and submit it yourself, by your own hand, on the official website.
3. Not Legal or Immigration Advice
Nothing in the Service is legal or immigration advice. Reference information we display (such as visa requirements) is for general orientation only and may be outdated or incomplete. Always verify against official government sources.
4. Not Affiliated with Any Government
visayes is not affiliated with, endorsed by, or operated on behalf of any government or official body.
Official arrival-card services are provided free of charge by the respective governments. visayes charges for its own preparation and assistance tooling — not for the government service itself.
5. No Guarantee of Outcomes
Using visayes does not guarantee that a form will be accepted, a visa granted, or entry permitted. Those decisions belong entirely to border authorities and officials. We also do not guarantee that any official website will be available or accept submissions at any given time.
6. Your Account
You must be at least 18 years old to create an account. You are responsible for your account credentials and for all activity under your account. Keep your login details secure.
7. Filling In for Fellow Travelers
You may prepare forms for people traveling with you — for example, family members, including minors. By doing so, you confirm that you have each person’s permission, or the permission of their parent or legal guardian, to enter and use their information, and you accept responsibility for its accuracy.
Their information is handled under the same data-handling rules described in our Privacy Policy: passport details, health declarations, and form answers all stay on your device.
8. Credits, Payment, and Refunds
- The Service uses prepaid credits. Payments are processed by Stripe; we never see your full card number.
- What counts as success: a service is successful at the moment the official website confirms it has received your submission. That is when a credit is charged. If our assistance fails before that moment, no credit is consumed.
- What happens after a successful submission — approval, rejection, or requests for more information from the authorities — is outside the Service and is not a service failure.
- Top-up balances are non-refundable to the extent permitted by applicable law. During checkout you consent to immediate service availability and, where applicable, waive the 14-day withdrawal right (Directive 2011/83/EU, Art. 16(m)).
- Successfully consumed credits are non-refundable.
- Credits never expire.
- We issue refunds for payment-system errors and for failures confirmed to be caused by our own bugs.
9. Your Responsibilities
You are solely responsible for the accuracy, completeness, and truthfulness of all information you submit through or with the help of the Service, and for verifying it against official sources before submitting. Submitting false information to a government can have serious legal consequences.
10. Acceptable Use
You agree not to: use the Service for unlawful purposes; probe, disrupt, or overload the Service; resell or white-label the Service without our written consent; attempt to extract our source code or data at scale; or use the Service to harm official websites.
11. Browser Extension
Our browser extension assists with typing your prepared information into official websites, inside your own browser. It does not submit forms for you and does not answer declarations for you — you review every field and personally click submit on the official website.
You are responsible for complying with the terms of use of the websites you visit. visayes does not act on those websites — all actions occur in your own browser, under your control.
12. Your Data Stays Yours; Our Service Stays Ours
You retain all rights to the information you enter. We claim no ownership of it.
The Service itself — including its software, design, and the content we authored — belongs to us and is protected by intellectual-property law. We grant you a personal, non-transferable license to use it while these Terms are in force.
13. Third-Party Services
The Service relies on third-party providers (payment, OCR, authentication, email — listed in our Privacy Policy). Their terms and privacy policies apply to their processing. Official government websites are not our partners or providers; we have no relationship with them.
14. Suspension and Termination
We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk for other users or for us. You may stop using the Service and request account deletion at any time (see Privacy Policy).
Sections that by their nature should survive termination — including 8, 9, 12, 15, 16, and 17 — survive.
15. Disclaimers and Limitation of Liability
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied.
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the amount you actually paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages — including visa refusals, denied boarding or entry, missed travel, or losses caused by official websites being unavailable.
Nothing in these Terms excludes liability that cannot be excluded by law.
16. Indemnification
You agree to indemnify and hold visayes harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.
17. Governing Law and Disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes shall be resolved by the courts of Hong Kong.
If you are a consumer in a jurisdiction whose law grants you mandatory consumer protections (including the EU), those protections are not affected by this section, including your right to bring proceedings in your own country of residence.
18. Changes to These Terms
We may update these Terms. For material changes we will give notice by email or in-product notification. Continued use after notice takes effect constitutes acceptance. The effective date above always reflects the current version.
19. General; Contact
These Terms and the Privacy Policy are the entire agreement between you and visayes about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a change of operator of the Service, with notice. Neither party is liable for delays caused by events beyond reasonable control.
